In March, 2014, a class of plaintiffs sued Western Union in federal court in Illinois. The plaintiffs claimed that they received unsolicited text messages to their cell phones from Western Union without their prior consent, in violation of the federal Telephone Consumer Protection Act (“TCPA”).

On October 28th, Western Union agreed to settle the TCPA suit by setting up an $8.5 million settlement fund. With a potential class of over 800,000 plaintiffs, attorneys representing the plaintiffs estimate that individual class members could receive between approximately $130 and $650 each, depending upon the percentage of members who submit valid claims in accordance with the settlement agreement.
